A Distant Echo
I just started reading Sir Antony Beevor’s latest book, “Russia – Revolution & Civil War, 1917 – 1921.” Included in the book are vivid examples of not just atrocities, most of which were inflicted by Russians on fellow Russians as opposed to atrocities by Russians on Ukrainians, but how Russian officers use their soldiers in combat. Given the accounts of how Russian soldiers are being used as cannon fodder in front of Bakhmut, not much has changed in Russian military strategy in the past 100+ years.
Russia’s latest invasion of Ukraine is only the most recent example of Russia’s longstanding penchant for committing atrocities. From reading Beevor’s account, it somehow seems ingrained.
Russia’s actions in Ukraine are often referred to by the pundits as “Putin’s invasion,” “Putin’s war,” and even “Putin’s atrocities.” The pundits should learn their history. It’s clear from the work done by Antony Beevor, and others including Anne Applebaum, that Russia’s penchant for committing atrocities existed well before Putin. The question is – will it continue after Putin departs the scene?
Agricultural Surprises
According to this recent report, that relies heavily on satellite data, Ukrainian agricultural production is larger than what was expected. Some additional anecdotal information:
· Farmers in the recently liberated areas of Kharkiv Oblast, started winter planting a week after liberation.
· Ukraine is supplying farmers with pre-harvest financing, helping farmers acquire seeds and other inputs for planting the 2023 harvest.
· The Wall St. Journal has reported that at least 1 Russian oligarch has expropriated farmland in occupied territories.
· Areas in newly liberated Kherson include substantial vegetable production.
News From the Battlefield
There may have been another attempted Russian missile attack yesterday, following the one that took place last Monday. Almost all of the missiles were shot town.
The Latest Denys includes a guided tour through the cockpit of a Russian Tu-95 bomber. He said it was from last year. It reminds me of the tour I got back in August 1972, at U-Tapao Airbase in Thailand, through the cockpit of a B-52 bomber. Russia is using Tu-95s as a platform to launch cruise missiles against Ukraine. The losses of Tu-95s Russia incurred in the recent attacks against their airbases inside Russia cannot be replaced. Neither the Tu-95’s engines nor the airframes are being produced in Russia. With respect to Denys’ account of the battlefield itself, the fighting around Pavlivka, north of Melitopol, is in the area where many expect Ukraine to launch its next counteroffensive.
“Reporting From Ukraine” focuses on Bakhmut, where he seems to conclude that Ukraine is gaining the upper hand. The video includes a report stating that Ukraine is moving more artillery into the area. Bakhmut is where forces from Yevgeniy Prigozhin’s Wagner Group are concentrated, a formation that now includes many freed Russian prisoners. In the table of Russian losses supplied by my colleague, Russian casualties are running at around 500/day. Most of these are concentrated in Bakhmut and in front of Donetsk. Another account describes Wagner’s strategy, of using the prisoners to launch attacks during the day, with the better equipped Wagner Group soldiers attacking at night.
War Crimes Investigation & the Establishment of the Special Tribunal
Courtesy of the “Kyiv Independent,” this is an interview with Fredrik Wesslau, a Swedish diplomat who is Deputy Head of the European Union Advisory Mission to Ukraine. He is a war crimes expert, and he talks about the extent the war crimes that have taken place, and the distinction between the proposed War Crimes Tribunal, and other relevant jurisdictions including the International Criminal Court, the Ukrainian Judicial System and other venues.
Wesslau says “There's currently no court that really has jurisdiction over the crime of aggression, which is specifically about the leadership. This is the mother of all crimes, which is, without which, the other crimes wouldn't have happened.” He further describes the mandate of the Tribunal, “Typically for the crime of aggression, it's a very small group, the inner core in a sense. This is about the closest people who are part of planning, preparing, instigating, and launching the aggression.”
Wesslau then discusses the question of whether the “propagandists,” the most famous of whom is arguably Margarita Simonyan the Head of “Russia Today, could be included as defendants in a Tribunal, “I think with the propagandists, it does fall a little bit outside the remit of crime of aggression in the sense. But there is more and more discussion amongst legal scholars about accountability for the propagandists, since, for instance on Russian state TV, you see quite hardcore propaganda, the inciting of violence of the most horrible kind. The question is, what is their role in this war effort, how do they influence the war and how are they culpable in all of this?”
There is an interesting, related question. Would Patriarch Kirill, Head of the Ukrainian Orthodox Church – Moscow Patriarchate, be considered a propagandist for purposes of inclusion as a defendant in a tribunal? Based on a number of his incendiary statements about Ukraine, there seems to be a strong argument supporting his inclusion as a propagandist.
